Section 40
Provisions relating to compliance with deadlines

(1) Regardless of what is written in the prevailing law, when the time limit is served in the name of a foreign person in the offense related to money laundering and financial investment in terrorist activities, if such person has any kind of office or representative in Nepal, the time limit shall be served in the name of such office or representative and the time served in such manner shall be duly served. (2) If there is no office or representative as per sub-section (1), the principal place of business of such person or the address of permanent residence or any address given by him for correspondence during the course of business, if such address is telex, telefax or other means of telecommunication that may be recorded. The due date shall be served through the medium or by registered post and the due date so served shall be deemed to have been duly served. (3) Notwithstanding anything written in sub-section (1) or (2), to serve the due date in the name of a person residing abroad, the Government of Nepal or the Nepalese party shall If there is a separate provision in any treaty, this clause shall not be considered as an obstacle to meet the deadline accordingly.
